Five law firms, one ball, and a shared goal: At the ROXIN CUP 2025, Littler Germany, GSK, BRL, REIMER, and ROXIN Rechtsanwälte came together on the pitch. The tournament was defined by team spirit, fair play, and sporting ambition – all in support of a good cause. Every goal scored was converted into a donation.

Once again, the proceeds will support Team Bananenflanke Itzehoe e.V., an organization that enables children and young people with disabilities to play football, be part of a team, and experience a strong sense of community.

Our support from last year has already made a significant impact: funding tournament trips, new equipment, community events, and unforgettable experiences for the children, their families, and the entire team. At the same time, the project continues to grow. Team Bananenflanke is now active at 26 locations, including its first international branch in Luxembourg.

For us, one thing is clear: inclusion happens where people create opportunities and foster meaningful connections. That is why we will continue our commitment in 2026.

Tax audits are becoming increasingly compelling and more and more frequently include criminal law issues. What are typical issues that auditors are focussing on? How can managers detect signs of escalation in the audit? How should companies communicate and strategically deal with auditors and, going forward, with criminal investigation authorities? These are questions ROXIN partner Dr. Ramona Höft will focus on in this webinar.

Suspicion of criminal offences is increasingly becoming the focus of tax auditors, who involve criminal investigation authorities if they come across any indication of misconduct. This puts companies and their managers in a communicative and strategic dilemma between cooperation within the framework of the tax audit and the most effective defence possible against criminal suspicions. Our speaker Ramona Höft (ROXIN) will use examples from her consulting practice to explain which topics are regularly subjected to a criminal law ‘screening’ in the tax audit, how the escalation in the ongoing audit becomes detectable and which communicative and strategic pitfalls companies and managers are exposed to in their further dealings with the authorities.

Dr. Michaela Möhlenbeck, experienced white-collar criminal lawyer and in-house counsel at leading German logistics group Deutsche Bahn since 2010, will join the ROXIN team as of Counsel.

Michaela Möhlenbeck fields exceptional expertise in white-collar crime and many years of practical experience, focusing in particular on foreign trade and export control issues, internal compliance investigations as well as anti-corruption and whistleblowing management.

In addition to her practice as lawyer and in-house counsel, Michaela Möhlenbeck has also been a lecturer at the University of Applied Sciences of the Saxon Administration in Meissen since 2008. She also passes on her criminal law know-how, with further fields of excellence in insolvency law, criminal tax law and as a certified compliance professional, in specialist publications.

Companies and their executives are increasingly facing fine proceedings for alleged administrative offenses. Providing real-life examples and useful tips from legal practice, ROXIN partner Johannes Altenburg will discuss the risks arising for companies as well as what line of action managers and legal or compliance teams should follow.

The reason for the growing number of fine proceedings against companies and managers is the increasing density of legal regulation and intensified prosecution of possible breaches of the law, even in cases of negligent behavior.

These fine proceedings are conducted by various different authorities with varying degrees of intensity. In principle, however, they always follow the regulations of the Administrative Offences Act (Ordnungswidrigkeitenrecht) and the Code of Criminal Procedure (Strafprozessordnung). In addition to the fines themselves, companies are often also running the risk of grave so-called secondary consequences. These can include records in the competition register or central trade register or the confiscation of profits.

In this webinar, ROXIN partner Johannes Altenburg will discuss how in fine proceedings companies and managers can minimise risk and at the same time maintain a constructive relationship with the respective authority. Participants will receive useful tips based on real-life examples. This webinar is best suited for legal and compliance teams as well as for managers.

In managing such cross-border investigations, the differences between national legal systems as well as logistical and cultural particularities at the various branch locations must all be taken into account.

As a guest expert at the EY Compliance Lounge Hamburg, our partner Oliver Sahan will share insights from the perspective of a white-collar criminal defense lawyer on pitfalls as well as helpful organizational measures to be taken in the case of cross-border investigations.

The amount of works council remuneration has become a permanent factor of uncertainty in practice. Our associate Sascha Knaupe has now published a new article on this relevant current topic together with Anne-Kathrin Bertke (Kliemt Employment Law). The article has been published in the Journal of International Criminal Law (ZfIStw) and is available free of charge.

At the same time this new article was set up for printing, German parliament adopted an amendment to the Works Constitution Act (BetrVG) in order to clarify the issue of remuneration of works council members.

The article by Knaupe/Bertke remains relevant and worth reading even even after this short-notice amendment – especially with regard to risks of criminal liability due to embezzlement for managers, and measures to be taken.

For interested readers, the latest changes made by the legislator are here summarized in brief:

• Companies have recently faced increased legal uncertainty regarding the suitable remuneration of works council members – and as a result, frequently applied preventive cuts.
• The legislator has now supplemented the prohibition of discrimination in the remuneration of works council members with a minimum remuneration claim. In future, their remuneration may not be less than the remuneration of comparable employees with normal company development.
• Section 37 of the Works Constitution Act (BetrVG) specifies the term “comparable employee”. The standard for remuneration as for a comparable employee is to be the time at which individual works council members took over their function (unless a later redetermination is objectively justified).
• Employers and works councils will be enabled to define “comparable employees” in works agreements. Resulting works agreements should be ruled out to be checked unless for gross errors.
• Section 78 of the Works Constitution Act (BetrVG) is supplemented by the clarification that no preferential treatment or disadvantage with regard to the remuneration paid may be suspected if the works council member meets the operational requirements for this.

In its online edition of September 30, 2024, leading German business newspaper Handelsblatt for the first time presented “Germany’s best commercial law firms” 2024.

At a national level, Handelsblatt counts ROXIN as one of the top firms in business criminal law. In addition, our firm receives regional recognitions for our practice in tax criminal law.

Handelsblatt researched the current selection of particularly respected law firms in cooperation with the reputable ranking portal Best Lawyers. The awards are based on the frequency with which these firms are recommended by other lawyers for their advice and market standing.

In June, Handelsblatt had highlighted five ROXIN lawyers from our Hamburg and Munich offices among the paper’s “best lawyers in Germany” ranking for their outstanding reputation in business criminal law as well as tax criminal law practice.

In August, ROXIN welcomes David Esser as a new associate in the firm’s Hamburg office. He strengthens the team with his professional focus on individual business criminal defense and in particular on defense in cross-border cases.

David Esser studied law at University of Cologne and at Eötvös Loránd University (Budapest), with a focus on criminology, juvenile criminal law and the prison system. During his studies, he worked as a research assistant in a renowned criminal law boutique in Cologne. David Esser completed his legal clerkship in Hamburg in the district of the Hanseatic Higher Regional Court, again with a focus on criminal law. At the same time, he worked as a research assistant at ROXIN and now returns to the firm as a lawyer and associate. With David Esser, ROXIN grows to ten lawyers, all specializing in business and tax criminal defense as well as in internal investigations, at the firm´s Hamburg office.
