Companies and their executives are increasingly facing fine proceedings for alleged administrative offenses. Providing real-life examples and useful tips from legal practice, ROXIN partner Johannes Altenburg will discuss the risks arising for companies as well as what line of action managers and legal or compliance teams should follow.
The reason for the growing number of fine proceedings against companies and managers is the increasing density of legal regulation and intensified prosecution of possible breaches of the law, even in cases of negligent behaviour.
These fine proceedings are conducted by various different authorities with varying degrees of intensity. In principle, however, they always follow the regulations of the Administrative Offences Act (Ordnungswidrigkeitenrecht) and the Code of Criminal Procedure (Strafprozessordnung). In addition to the fines themselves, companies are often also running the risk of grave so-called secondary consequences. These can include records in the competition register or central trade register or the confiscation of profits.
